By accessing or using the Nano Banana Batch website and services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree to these Terms, you may not use the Service. "You" refers to the individual or entity using the Service. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. The Service

Nano Banana Batch provides an AI-powered batch image generation service. You can upload an image ("Input Content"), provide text prompts, and generate multiple new images ("Generated Content"). The Service is offered through various subscription plans and credit packs, as detailed on our Pricing page.

We reserve the right to modify or discontinue the Service at any time. The Service is provided on an "AS IS" and "AS AVAILABLE" basis.

3. User Accounts

To use certain features of the Service, you must register for an account. You agree to provide accurate and complete information and to keep this information up to date. You are responsible for safeguarding your password and for all activities that occur under your account. You must be at least 13 years old to use the Service.

4. Content Ownership and Rights

4.1. Your Input Content

You retain all ownership rights to your Input Content (the images you upload). You grant Nano Banana Batch a limited, worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and process your Input Content solely for the purpose of providing and improving the Service to you. This license ends when you delete your Input Content or your account.

4.2. Generated Content

You own the Generated Content you create using the Service, provided you are on a paid plan. Subject to your compliance with these Terms, Nano Banana Batch grants you full rights, including copyright and commercial rights, to the Generated Content created under your paid account. You are free to use this Generated Content for any purpose, personal or commercial, without royalties or attribution.

Generated Content created under a free trial may require attribution to "Nano Banana Batch" if used publicly.

4.3. Our Content

The Service itself, including our website, branding, templates, and underlying technology, is the exclusive property of Nano Banana Batch and its licensors.

5. Acceptable Use Policy

You agree not to use the Service to:

  • Upload or generate any content that is unlawful, harmful, defamatory, obscene, or hateful. This includes, but is not limited to, content that promotes discrimination, bigotry, racism, or harm against any individual or group.
  • Create sexually explicit material, including nonconsensual intimate imagery.
  • Generate content that infringes upon any third party's rights, including copyright, trademark, privacy, or other proprietary rights.
  • Create misleading, deceptive, or harmful misinformation (e.g., malicious deepfakes).
  • Attempt to reverse-engineer, decompile, or otherwise discover the source code of the Service.

We reserve the right to suspend or terminate accounts that violate this policy.

6. Payments, Subscriptions, and Refunds

Fees: You agree to pay all fees associated with your chosen plan or credit pack. All payments are handled by a secure third-party payment processor.

Subscriptions: Subscription plans are billed in advance on a recurring basis (e.g., monthly or annually). They will automatically renew unless you cancel your subscription through your account settings before the renewal date.

Credits: Credits are consumed when you generate images. The cost per image may vary based on features like upscaling. Unused credits from monthly subscriptions may or may not roll over, as specified in your plan details. Credits purchased in packs do not expire.

Refunds: We offer a 30-day money-back guarantee for new subscription purchases. Please contact us at support@nanobananabatch.com to request a refund.

7. Termination

You may terminate your account at any time by contacting support or through your account settings. We may suspend or terminate your access to the Service at our discretion, without notice, for conduct that we believe violates these Terms or is otherwise harmful to other users of the Service, us, or third parties.

8. Disclaimers and Limitation of Liability

THE SERVICE IS PROVIDED "AS IS." NANO BANANA BATCH DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

IN NO EVENT SHALL NANO BANANA BATCH BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

9. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of any material changes. By continuing to use the Service after changes have become effective, you agree to be bound by the revised Terms.
